Welcome to ATE Food (“ATE Food,” “ATE,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the ATE Food mobile application, website, software, features, content, tools, and related services collectively, the “Service”.

ATE Food is a lifestyle food-journaling and food-awareness app that helps users understand eating patterns, calorie estimates, meal habits, and personal food preferences. ATE Food is not a medical, healthcare, diagnostic, treatment, or clinical nutrition service.

By downloading, accessing, or using the Service, creating an account, uploading a photo, logging a meal, viewing insights, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.

1. The ATE Food Service

ATE Food helps users record and reflect on their food choices. Depending on the features available to you, the Service may allow you to:

  • Take or upload food photos.
  • Log meals, snacks, drinks, notes, moods, locations, tags, or meal context.
  • Receive AI-assisted food recognition and calorie estimates.
  • View estimated nutrition information.
  • Track meal timing, food patterns, preferences, and habits.
  • Review personal food journals, history, trends, and insights.
  • Set lifestyle goals, reminders, or reflection prompts.
  • Save favorite foods, meals, or preferences.
  • Sync or access information across supported devices.
  • Use other related food-awareness and journaling features.

The Service may change over time. We may add, remove, suspend, modify, or limit features at any time.

2. Lifestyle and Food-Awareness Purpose Only

ATE Food is designed for general lifestyle awareness, self-reflection, and personal food journaling.

ATE Food does not provide:

  • Medical advice.
  • Healthcare services.
  • Diagnosis.
  • Treatment.
  • Prevention of disease.
  • Clinical nutrition therapy.
  • Dietitian services.
  • Eating disorder treatment.
  • Allergy, safety, or ingredient verification.
  • Personalized medical recommendations.
  • Emergency health support.

You should not use ATE Food as a substitute for advice from a physician, registered dietitian, nutritionist, therapist, or other qualified professional.

If you have a medical condition, food allergy, diabetes, pregnancy-related nutrition needs, an eating disorder, a history of disordered eating, or other health-related concerns, consult a qualified professional before relying on any food, calorie, or nutrition information.

3. Calorie and Nutrition Estimates

ATE Food may provide estimated calories, food identification, portion estimates, macronutrient estimates, nutrition information, trends, or related insights.

These outputs are estimates only. They may be inaccurate, incomplete, delayed, inconsistent, or unsuitable for your circumstances.

You understand that:

  • Food items may be misidentified.
  • Portion sizes may be estimated incorrectly.
  • Calorie estimates may differ from actual calories.
  • Nutrition information may be based on averages, databases, assumptions, or user-provided information.
  • Homemade meals, mixed dishes, sauces, oils, hidden ingredients, toppings, cooking methods, and serving sizes can significantly affect actual nutrition.
  • AI-assisted outputs are not guaranteed to be accurate.
  • ATE Food does not verify whether food is safe for you to eat.
  • ATE Food does not detect allergens or confirm ingredient lists.

You are responsible for reviewing, correcting, interpreting, and deciding whether to use any estimate, result, or insight.

4. AI-Assisted Features

Some features may use artificial intelligence, automated image analysis, machine learning, or similar technologies to help identify foods, estimate calories, summarize habits, or generate insights.

AI-assisted features are probabilistic and may produce incorrect or unexpected results. Confidence scores, labels, estimates, or suggestions are not guarantees.

You agree not to rely on AI-assisted outputs as the sole basis for medical, safety, dietary, legal, financial, or other significant decisions.

5. Eligibility

You must be at least 13 years old to use the Service, unless a higher age is required in your jurisdiction.

If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

ATE Food is not intended for children under 13.

6. Accounts

You may need to create an account to use some features.

You agree to:

  • Provide accurate and current information.
  • Keep your login credentials secure.
  • Not share your account with others.
  • Promptly notify us of unauthorized access.
  • Be responsible for activity under your account.

We may suspend or terminate your account if we believe your account has been compromised, misused, or used in violation of these Terms.

7. Your Food Journal and User Content

“User Content” means photos, meal logs, notes, tags, favorites, goals, preferences, feedback, text, images, and other materials you submit, upload, save, or transmit through the Service.

You retain ownership of your User Content. You grant ATE Food a limited, worldwide, non-exclusive, royalty-free license to host, store, process, analyze, display, transmit, and use your User Content as necessary to provide, maintain, secure, personalize, support, and improve the Service.

You represent that:

  • You have the right to submit your User Content.
  • Your User Content does not violate the rights of others.
  • Your User Content does not violate applicable law.
  • You will not upload content that you are not authorized to use.

You should avoid uploading images that include faces, children, private documents, payment cards, medical records, government IDs, or other sensitive information not needed for food journaling.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, disclose, and protect information.

Because ATE Food may process food logs, calorie estimates, preferences, habits, and wellness-related information, you should carefully review our Privacy Policy before using the Service.

Certain health and wellness apps may be subject to breach-notification or privacy obligations depending on the data collected, how the service is structured, and applicable law. For example, the FTC Health Breach Notification Rule applies to certain vendors of personal health records and related entities in the event of breaches involving unsecured information. 9. Device Permissions

To use certain features, you may choose to grant permissions such as camera access, photo library access, notifications, health or fitness integrations, location, or background activity.

You can change permissions through your device settings. Some features may not work properly if permissions are disabled.

ATE Food is not responsible for your device settings, operating system restrictions, app store settings, or third-party platform behavior.

10. Notifications and Reminders

ATE Food may allow you to enable reminders, push notifications, meal prompts, streaks, habit nudges, or other alerts.

Notifications are optional and may be managed through the app or your device settings. Reminders are provided for convenience only and should not be treated as medical, nutritional, or safety instructions.

11. Subscriptions, Purchases, and Billing

Some features may be free. Others may require payment, a subscription, in-app purchase, or premium plan.

If you purchase a paid feature, you agree to pay all applicable fees, taxes, and charges. Pricing, renewal terms, billing period, included features, and cancellation terms will be disclosed at the time of purchase or in the applicable app store checkout flow.

If you purchase through the Apple App Store or Google Play, billing, renewal, cancellation, and refunds may be handled by that platform under its own terms. Apple states that subscriptions purchased in apps can be cancelled through the App Store on your device, and Google states that Google Play subscriptions are charged according to their billing cycle unless cancelled. Unless otherwise required by law or expressly stated, fees are non-refundable.

We may change pricing, plan names, included features, or subscription terms prospectively. Where required, we will provide notice before material changes take effect.

12. Free Trials and Promotions

We may offer free trials, discounts, promotional credits, beta access, or limited-time offers.

Promotions may have additional terms, eligibility rules, usage limits, and expiration dates. Unless otherwise stated, we may modify or end promotions at any time.

If a free trial converts to a paid subscription, the applicable renewal and billing terms will be disclosed before purchase or as otherwise required by law.

13. Acceptable Use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right.
  • Upload content you do not have permission to use.
  • Upload unlawful, harmful, abusive, harassing, defamatory, obscene, exploitative, or invasive content.
  • Upload images of other people without appropriate consent.
  • Misrepresent ATE Food as a medical, clinical, diagnostic, or treatment tool.
  • Use ATE Food to provide medical, dietetic, clinical, or therapeutic services without appropriate professional oversight.
  • Use the Service to make decisions about allergies, food safety, medical conditions, medications, or treatment.
  • Interfere with or disrupt the Service.
  • Attempt to bypass security, access controls, subscriptions, usage limits, or authentication.
  • Reverse engineer, scrape, copy, decompile, or attempt to extract the source code, models, datasets, or underlying systems.
  • Use automated systems to overload or abuse the Service.
  • Upload malware, harmful code, or security exploits.
  • Create a competing product using unauthorized access to the Service.
  • Use the Service in a way that harms ATE Food, other users, or third parties.

We may investigate suspected violations and may suspend or terminate access.

14. Eating Disorders and Sensitive Use

ATE Food is intended to support food awareness and reflection, not obsession, restriction, shame, or harmful behavior.

If calorie estimates, food tracking, meal logging, or habit insights cause distress, anxiety, compulsive behavior, or disordered eating patterns, stop using the Service and consider seeking support from a qualified professional.

ATE Food is not designed to diagnose, prevent, monitor, or treat eating disorders.

15. Food Allergies and Food Safety

ATE Food does not identify allergens, verify ingredients, determine whether food is safe to eat, detect contamination, or provide food safety warnings.

Do not rely on ATE Food to determine whether a food contains allergens, is safe for you, is properly prepared, or complies with your dietary restrictions.

Always check labels, ingredient lists, restaurant disclosures, and professional guidance when food safety or allergies are involved.

16. User Responsibility

You are responsible for:

  • The food choices you make.
  • The information you enter.
  • Reviewing and correcting your logs.
  • Interpreting estimates and insights appropriately.
  • Deciding whether ATE Food is suitable for your personal use.
  • Consulting professionals when needed.

ATE Food provides tools and information, but you remain responsible for your own decisions.

17. Third-Party Services

The Service may integrate with third-party services, platforms, app stores, analytics tools, cloud providers, nutrition databases, AI systems, health or fitness platforms, payment processors, or authentication providers.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content, outages, data practices, or decisions.

18. App Store Terms

If you downloaded ATE Food from the Apple App Store, Google Play, or another app marketplace, you also agree to comply with that platform’s applicable terms.

The app marketplace may not be responsible for supporting, maintaining, or providing warranties for ATE Food. To the extent required by platform rules, the applicable app marketplace and its affiliates may be third-party beneficiaries of these Terms for apps distributed through that platform.

19. Ownership and Intellectual Property

ATE Food and its software, design, trademarks, logos, features, models, workflows, text, graphics, icons, interfaces, databases, and other content are owned by ATE Food or its licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own lawful personal use.

You may not copy, sell, rent, lease, distribute, modify, create derivative works from, or exploit the Service except as expressly permitted by these Terms.

20. Feedback

If you send us feedback, ideas, suggestions, bug reports, or feature requests, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, publish, commercialize, and incorporate that feedback without compensation to you.

21. Availability and Changes

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

The Service may be unavailable due to maintenance, updates, outages, network issues, third-party failures, security events, system limitations, or events beyond our control.

We may modify, suspend, discontinue, or limit any part of the Service at any time.

22. Beta Features

We may offer beta, preview, experimental, or early-access features.

Beta features may be incomplete, inaccurate, unstable, or discontinued. They are provided for testing and feedback and should not be relied on for important decisions.

23. Termination

You may stop using ATE Food at any time. You may delete your account if account deletion is supported in the app or by contacting us at the address below.

We may suspend or terminate your access if:

  • You violate these Terms.
  • Your use creates legal, security, operational, or reputational risk.
  • Your account is associated with fraud, abuse, or misuse.
  • We are required to do so by law.
  • We discontinue the Service.

After termination, your right to use the Service ends immediately. Sections that by their nature should survive will survive, including ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and payment obligations.

24. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.

We do not warrant that:

  • The Service will meet your expectations.
  • Food recognition will be accurate.
  • Calorie estimates will be correct.
  • Nutrition information will be complete.
  • Insights will be useful or appropriate for you.
  • The Service will identify allergens or unsafe foods.
  • The Service will be uninterrupted or error-free.
  • Any defects will be corrected.

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.

25. Limitation of Liability

To the fullest extent permitted by law, ATE Food and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, personal injury, emotional distress, business interruption, or costs of substitute services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:

  1. The amount you paid to ATE Food in the three months before the event giving rise to the claim; or
  2. USD $100.

These limitations apply regardless of legal theory, even if we have been advised of the possibility of damages.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

26. Indemnification

You agree to defend, indemnify, and hold harmless ATE Food and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Service.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of law.
  • Your violation of third-party rights.
  • Your reliance on food, calorie, nutrition, or habit estimates.
  • Your misuse of the Service.

27. Governing Law

These Terms are governed by the laws of Georgia, USA, without regard to conflict-of-law rules.

If you are a consumer, this section does not limit mandatory rights you may have under the laws of your place of residence.

28. Dispute Resolution

Before filing a claim, you agree to contact us at support@atefood.app and attempt to resolve the dispute informally.

If we cannot resolve the dispute informally, disputes will be resolved in the courts located in Lithonia, GA, unless a different process is required by law or agreed in writing.

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by [Insert Arbitration Provider] under its applicable rules. The arbitration will take place in [Insert Location] or remotely where permitted. You and ATE Food waive the right to a jury trial and agree to bring claims only in an individual capacity, not as a class action or representative proceeding, except where prohibited by law.

29. Changes to These Terms

We may update these Terms from time to time. When we update them, we will revise the “Last Updated” date above.

If changes are material, we may provide additional notice through the app, website, email, app store listing, or other reasonable means.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree, stop using the Service.
